Terms of Service

Prompy is run by LMA TECH LTDA, a company registered in Brazil under CNPJ 64.160.688/0001-50, with its registered office at R. Rio Tamisa, 41, Jardim dos Lagos, Indaiatuba-SP, 13340-229, Brazil. In these terms, we and us mean LMA TECH LTDA, and you means the person who uses Prompy.

By creating an account or using Prompy, you agree to these terms. Our Privacy Policy explains how we handle your data.

Prompy is an image generator. You pick curated filters and an effort level. Every click writes a studio-grade prompt on our servers, and Prompy renders four images from it.

You can use Prompy in three ways:

• the web app at prompy.io;
• the public API under /v1;
• the MCP server, which lets AI assistants you authorize use Prompy for you.

All three use the same account, plan and credit balance.

You must be at least 18 years old to create an account or use Prompy.

You may hold one account.

You sign in through our login provider. Keep your login secure. You are responsible for what happens in your account.

API keys act on your behalf and can spend your credits. We show a key once, when you create it, and we store only a hash of it. Keep keys secret, never put them in client code or public repositories, and revoke any key you think has leaked. You can revoke a key at any time from your account.

If you think someone else is using your account, write to hello@prompy.io right away.

Prompy has three plans. Prices are in US dollars. Taxes may be added at checkout.

Plans renew automatically at the end of each period until you cancel. Annual plans are billed once a year and still grant credits month by month.

Generating images requires an active plan or trial. Without one, you can still browse the filter catalog and use the free filters to build and copy a prompt.

Credits pay for generations and upscales. The app, the API and the MCP server show the cost in credits before you spend them. If your balance cannot cover a full set of four images, we offer smaller options so you can use what is left.

Plan credits expire every month. Your plan grants a new batch of credits each month, and any plan credits you did not use expire at that point. They do not roll over, and this also applies to annual plans.

We spend credits in this order: trial or plan credits first, because they expire sooner, then top-up credits, oldest first.

Credits belong to your account. You cannot sell or transfer them.

The trial costs $1, charged when you start it, and lasts 3 days. It gives you 40 credits and access to every filter.

Unless you cancel before the 3 days end, the trial converts into a Starter monthly plan at $14 per month, and we charge your card on day 4. If you cancel during the trial, you keep access until the 3 days end and you will not be charged again.

Trial credits expire when the trial ends. Each person can take the trial once. We may decline a trial when the same card, email address, device or network has already been used for one. During the trial you can buy one top-up of up to $10, using the same card.

Top-ups add credits on top of your plan.

Top-up credits stay valid for 12 months from purchase. We use them only after your plan or trial credits run out.

Buying a top-up requires an active plan or trial. Packs above $10 are for subscribers. If your trial ends without a plan, you can keep using the top-up credits you already bought, but you cannot buy new credits until you subscribe.

Payments are processed by Creem, which acts as our merchant of record. That means Creem is the seller of your plan, trial and top-ups. Creem charges your card, collects and pays sales tax or VAT where it applies, and issues your receipts. Creem has its own terms for the purchase, which you accept at checkout. We accept cards only, in US dollars.

Credits reach your account only after the payment is confirmed to us.

Our Refund and Cancellation Policy explains when we refund a charge and how to ask. Creem issues every refund, as the seller. If we close your account for reasons other than fraud, we refund the unused part of the top-ups you paid for.

Please contact us before you dispute a charge with your bank. When a chargeback is opened, we freeze the account, remove its remaining credits, and delete its images after 30 days.

You can cancel your plan at any time from your account. When you cancel, you keep access and the credits you have until the end of the period you already paid for. After that, the plan does not renew.

Top-up credits you bought stay valid for their 12 months. To generate with them, you need an active plan.

On the trial, Starter and Pro, we keep each image for 15 days. After that we delete it. Download anything you want to keep.

On Studio, your images do not expire while the plan is active. This includes up to 14 days with a failed payment while we retry it. Unlimited storage covers images generated in your account.

If you cancel Studio or move to another plan, images older than 15 days get a 30-day grace period. We email you when it starts and again before it ends. If you subscribe to Studio again during the grace period, you keep everything. After it ends, we delete those images, and the 15-day rule of your new plan applies.

You can delete any of your images yourself at any time.

You may not use Prompy to create, request or share:

• sexual content involving minors, in any form;
• intimate or sexual images of a real person without their consent;
• images that depict real people in a deceptive way, such as fake events, statements or endorsements;
• content that infringes trademarks, copyrights or other rights of others;
• content that is illegal where you live or in Brazil.

You also may not:

• bypass credit checks, rate limits, moderation or our fraud prevention;
• create several accounts to take more than one trial;
• resell, share or transfer credits or access to your account;
• attack, overload or probe Prompy, or access it in ways we do not offer.

We check requests and generated images automatically before showing them to you. When we block a request, it costs no credits.

We keep the text of a blocked request for 30 days to review abuse. If an account keeps breaking the rules, we suspend generation, refund the unused part of its paid top-ups, and close the account.

The images you generate are yours, to the extent the law and the terms of the model providers we use allow. We claim no ownership of them.

You give us the permission we need to store your images and prompts, process them, and deliver them to you, only to run Prompy for you. This permission ends when the images are deleted.

Some places do not protect images made with AI the way they protect other works. You are responsible for how you use your images, including checking that they do not infringe the rights of others.

The Prompy app, the filter catalog and the Prompy name and logo belong to us.

The API and the MCP server follow these terms. Requests through them spend the same credits as the web app.

Rate limits depend on your plan and apply per key and per account. Every API response carries RateLimit headers with your limit, what remains and when it resets. Stay within your limits, and do not spread requests across accounts or keys to get around them.

When you connect an AI assistant through the MCP server, it can spend your credits within the permissions you grant. You are responsible for what it does with that access. You can revoke it at any time.

Test keys return fixed sample images and cost no credits.

We work to keep Prompy running, but we provide it “as is” and “as available”. We do not promise that it will always be available, free of errors, or that every image will match what you had in mind.

We may change the models behind each effort level, or pause generation, to protect quality, security or cost. When a generation fails on our side, we return its credits.

To the extent the law allows, our total liability to you for any claim about Prompy is capped at the amount you paid us in the 12 months before the claim.

Nothing in these terms limits liability that the law does not allow us to limit, or your rights as a consumer under the law that applies to you.

You can stop using Prompy and delete your account at any time. Our Privacy Policy explains what we delete and when.

We may suspend or close your account if you break these terms, if the law requires it, or to protect Prompy or other people. In cases of fraud, such as a stolen card or a chargeback, we stop generation at once, remove the remaining credits, and delete the images after 30 days.

We may update these terms. The date at the top shows the latest version. When a change matters to you, we tell you by email or in the app before it takes effect. If you keep using Prompy after that, the new terms apply. If you do not agree, you can cancel.

The laws of Brazil govern these terms. This does not take away protections that the law of your country gives you as a consumer.
